Agreement to Terms
By accessing or using Comza ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.
Description of Service
Comza is an international calling service that allows users to make affordable phone calls to over 200 countries directly from their web browser. The Service uses Voice over Internet Protocol (VoIP) technology to route calls through telecommunications networks.
User Accounts
To use Comza's calling services, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete information when creating your account
- Notifying us immediately of any unauthorized use of your account
Acceptable Use
You agree not to use Comza to:
- Violate any applicable laws or regulations, including telecommunications regulations
- Make fraudulent, harassing, or threatening calls
- Use the Service for illegal activities, including but not limited to fraud, harassment, or violation of privacy
- Interfere with or disrupt the Service, servers, or telecommunications networks
- Attempt to gain unauthorized access to any part of the Service
- Resell or redistribute the Service without our express written consent
- Reverse engineer, decompile, or disassemble the Service
- Use automated systems to make calls in violation of applicable laws (e.g., TCPA, CAN-SPAM)
Payment and Credits
Comza operates on a prepaid credit system. By purchasing credits, you agree to:
- Pay all fees associated with credit purchases
- Credits are deducted based on actual call duration and destination rates
- Credits are non-refundable except as required by law or in cases of service failure
- Call rates may vary by destination country and are subject to change
- Unused credits do not expire unless otherwise specified
- All charges are calculated in USD and displayed before call initiation
Intellectual Property
The Service, including its original content, features, and functionality, is owned by Comza and protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of the Service without our express written permission.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. Your use of the Service is at your own risk.
Limitation of Liability
To the maximum extent permitted by law, Comza shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. Comza is not responsible for call quality issues, network failures, or service interruptions beyond our reasonable control.
Call Quality and Service Availability
Comza provides calling services through third-party telecommunications providers. You acknowledge and agree that:
- Call Quality: Call quality may vary based on network conditions, destination country infrastructure, and other factors beyond our control.
- Service Availability: We do not guarantee uninterrupted service availability and are not liable for service outages or network failures.
- Third-Party Providers: We rely on telecommunications partners (including Twilio) to route calls. Their service limitations may affect call quality and availability.
- No Guarantee of Connection: We cannot guarantee that all calls will connect successfully, especially to certain destinations or during network issues.
- Emergency Services: Comza does not support emergency calling (911, 112, etc.). Always use traditional phone services for emergencies.
Indemnification
You agree to defend, indemnify, and hold harmless Comza and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms, including but not limited to violations of telecommunications regulations.
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of the United States.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
